HC: BPL card benefit to candidate only if it is made prior to job advt
Bhopal/Jabalpur: MP high court said that the benefit of a BPL card should be given to a candidate if it was made before the date of advertisement of vacancies for a post.
A BPL card made after the vacancies are advertised should not be considered for giving benefits of BPL card holder to a person. With this observation, the court cancelled the 10 extra marks given to a candidate on the basis of her BPL card in the recruitment of anganwadi workers.
The petitioner Savita said that she had applied for recruitment as anganwadi worker at village Kaka Dehi in Nimadi district.
Respondent in her petition Shanti Kushwaha was given 10 extra marks due to the BPL card that she had and she was selected. She contended that Savita's BPL card was obtained after the post was advertised on March 16, 2024. The last date for submission of application was March 31, 2024 and her BPL card was made on March 24.
She argued that benefits of any documents should be given to a candidate which a candidate has on the day vacancies are advertisement for a post. The respondent didn't have a BPL card when the post was advertised but she obtained one later on to get 10 extra marks, which is not justified and she should not be given 10 additional marks. The bench of Justice Vivek Agarwal while allowing the PIL ordered cancellation of 10 marks given to respondent due to her BPL card. TNN
