Jaipur: Rajasthan High Court on Thursday directed the state govt to file a reply on why tenure of members of Juvenile Justice Board (JJB) of Tonk and Sawai Madhopur had not been extended.
Since Model Code of Conduct has come into effect for Lok Sabha elections, new members cannot be appointed. In such a situation, JJB are not functioning in two districts.
Hearing the petition, a single bench of Justice Mahendra Kumar Goyal, directed additional advocate general BS Chhaba to submit his reply.
Counsel for petitioner Laxmikant Sharma in the court maintained that the petitioners were appointed on April 22, 2021 for three years. This period was completed on April 22, but due to the code of conduct for Lok Sabha elections in the state, new members could not be appointed.
The state government extended the tenure of the members of JJB and Child Welfare Committee of many districts till the appointment of new members. In such a situation, the board is not able to function as tenure of members has not been extended. The petitioner is a woman member of the Tonk JJB. It is necessary to have a woman member in the board to hear cases related to women.
